"The Company" shall mean Make Snow Dot Net, and/or it's agents and/or it's owners and/or associates and/or affiliates.
"The Purchaser" shall mean any one who completes a purchase with The Company, and their agents, associates, and/or affiliates
All purchases made between The Company shall be held to the following terms. By making a purchase from makesnow.net or it's agents, owners, or associates you have accepted your agreement of these terms.
1. Any action taken against The Company shall be taken in the courts of the Province of Ontario, Canada.
2. Nozzles, adapters and accessories have no warranty. Snowmakers are guaranteed to make snow when temperatures are below -4C and the snowmaker is being used in combination with a pressure washer and air compressor as required by the product description. All claims must be made within 4 months of purchase. The Company will replace the product, repair the defects, or refund the purchase price or a portion of the purchase price, less shipping costs at the discretion of The Company.
3. In all transactions between The Company and any legal business or corporate entity or person who represents themselves as a legal business or corporate entity by which it is legal to waive statutory waranties, all such warantees shall be waived by all parties.
4. All purchases are made FOB shipping point, and therefore the buyer assumes all risk associated with shipping from the point at which The Company transfers the product to the carrier. All items are shipped by Canada Post unless the buyer pays for UPS shipping on the most expensive product (by dollar value) by selecting that option at the time of purchase. All shippments outside of the Canadian provinces and the continental United States of America may be subject to additional shipping charges up to the total cost of shipping plus 10% of the sum of the purchase price plus shipping costs as a handling fee.
5. Any refunds must be pre-approved by The Company prior to shipping back to The Company. Customers are responsible for all shipping costs incurred when making a return. Returns may be subject to a 20% restocking and inspection fee.
6. Snowmaking can be dangerous, consequently care should be taken when making snow; eye and hearing protection should be used at all times around air compressors, pressure washers, and pressurized hoses. Only use parts designed for the pressures which they will be used under.
7. The Company provides the guides soley for advice and are not liable for any damages or injury which result from following, however acurately or inaccurately, the directions posted on this website. If you doubt your ability to construct a snowgun that can be safely operated, do not attempt this project.
8. The Company is not liable for any injury or damages towards anyone using any equipment or parts purchased by the company. By making a purchase from The Company The Purchaser agress that they will indemnify The Company against any injury or damages which result from the operation, possession, or transportation of purchases from The Company. This clause includes, but is not limited to: any injuries caused by falling, tipping, or unstable snowmaking equipment; any injuries caused by projectiles, water damage, damage to air compressors, and/or pressure washers from use of purchases from The Company; any damages resulting from operating equipment purchased from The Company in improper areas or at times where noise, water, or electricity use has been limited by the local, municipal, territorial (state, province, region, etc.) or federal governments or any other authority who has the ability to legally have a claim against The Purchaser resulting from the use of the products purchased. |
